> One can no more prevent the mind from returning to an idea than the sea from returning to a shore. In the case of the sailor, this is called a tide; in the case of the guilty, it is called remorse.

> The mind's eye can nowhere find anything more dazzling nor more dark than in man; it can fix itself upon nothing which is more awful, more complex, more mysterious, or more infinite. There is one spectacle grander than the sea, that is the sky; there is one spectacle grander than the sky, that is the interior of the soul.
>
> To write the poem of the human conscience, were it only of a single man, were it only of the most infamous of men, would be to swallow up all epics in a superior and final epic. The conscience is the chaos of chimeras, of lusts and of temptations, the furnace of dreams, the cave of the ideas which are our shame; it is the pandemonium of sophisms, the battlefield of the passions. At certain hours, penetrate within the livid face of a human being who reflects, and look at what lies behind; look into that soul, look into that obscurity. There, beneath the external silence, there are combats of giants as in Homer, melees of dragons and hydras, and clouds of phantoms as in Milton, ghostly labyrinths as in Dante. What a gloom enwraps that infinite which each man bears within himself, and by which he measures in despair the desires of his will, and the actions of his life!

For to have the life of a fellow-man laid upon one's conscience—deserved he his death, or deserved it not—is to my sense of right and wrong the heaviest of all burdens; and the one that wears most deeply inwards, with the dwelling of the mind on this view and on that of it.

In this Behaviour, methinks, there appears something like a Consciousness of Guilt, it looks as if they endeavor'd to save themselves from the Imputation of a Crime (which they know sticks somewhere) by removing the cause of it as far as they can from themselves; and I can discover in it some strong remains of Primitive Pity and Innocence, which all the arbitrary Power of Custom, and the violence of Luxury, have not yet been able to conquer.

> Here I was walking around so hungry that my intestines were squirming inside me like snakes, and I had no guarantee there would be something in the way of food later in the day either. And as time went on I was getting more and more hollowed out, spiritually and physically, and I stooped to less and less honourable actions every day. I lied without blushing to get my way, cheated poor people out of their rent, even had to fight off the thought, mean as could be, of laying hands on other people's blankets, all without remorse, without a bad inner conscience. Rotten patches were beginning to appear in my inner being, black spongy growths that were spreading more and more. And God sat up in his heaven keeping a watchful eye on me, making sure that my destruction took place according to all the rules of the game, slowly and steadily, with no let-up. But in the pit of hell the devils were raising their hackles in fury because it was taking me such a long time to commit a cardinal sin, an unforgivable sin for which God in his righteousness had to cast me down.

> The political freedom of conscience and of the press, so far from being as it is commonly supposed an extension, is a new case of the limitation of rights and discretion. Conscience and the press ought to be unrestrained, not because men have a right to deviate from the exact line that duty prescribes, but because society, the aggregate of individuals, has no right to assume the prerogative of an infallible judge, and to undertake authoritatively to prescribe to its members in matters of pure speculation.

> The central principle of Fritz Bauer's career was that Germans should hold judgement upon themselves. That meant prosecuting ordinary Germans, not just the leaders whom the Allies had prosecuted. [...] The Nazi defendants being prosecuted by Bauer all tended to offer the same set of excuses [...]. Bauer's response, which he formulated again and again at the trials and in public, was as follows. Those Germans whom he was prosecuting were committing crimes against humanity. The laws of the Nazi state were illegitimate. One cannot defend one's actions by saying that one was obeying those laws. There is no law that can justify a crime against humanity. Everybody must have his own sense of right and wrong and must obey it, independently of what a state government says. Anyone who takes part in what Bauer called a murder machine [...] thereby becomes guilty of a crime.

> Eichmann, much less intelligent and without any education to speak of, at least dimly realized that it was not an order but a law which had turned them all into criminals. The distinction between an order and the Führer's word was that the latter's validity was not limited in time and space, which is the outstanding characteristic of the former. This is also the true reason why the Führer's order for the Final Solution was followed by a huge shower of regulations and directives, all drafted by expert lawyers and legal advisors, not by mere administrators; this order, in contrast to ordinary orders, was treated as a law. Needless to add, the resulting legal paraphernalia, far from being a mere symptom of German pedantry and thoroughness, served most effectively to give the whole business its outward appearance of legality. And just as the law in civilized countries assumes that the voice of conscience tells everybody, "Thou shalt not kill," even though man's natural desires and inclinations may at times be murderous, so the law of Hitler's land demanded that the voice of conscience tell everybody: "Thou shalt kill," although the organizers of the massacres knew full well that murder is against the normal desires and inclinations of most people. Evil in the Third Reich had lost the quality by which most people recognize it — the quality of temptation.

> Let us suppose that the great empire of China, with all its myriads of inhabitants, was suddenly swallowed up by an earthquake, and let us consider how a man of humanity in Europe, who had no sort of connection with that part of the world, would be affected upon receiving intelligence of this dreadful calamity. He would, I imagine, first of all, express very strongly his sorrow for the misfortune of that unhappy people, he would make many melancholy reflections upon the precariousness of human life, and the vanity of all the labours of man, which could thus be annihilated in a moment. He would too, perhaps, if he was a man of speculation, enter into many reasonings concerning the effects which this disaster might produce upon the commerce of Europe, and the trade and business of the world in general. And when all this fine philosophy was over, when all these humane sentiments had been once fairly expressed, he would pursue his business or his pleasure, take his repose or his diversion, with the same ease and tranquillity, as if no such accident had happened. The most frivolous disaster which could befall himself would occasion a more real disturbance. If he was to lose his little finger to-morrow, he would not sleep to-night; but, provided he never saw them, he will snore with the most profound security over the ruin of a hundred millions of his brethren, and the destruction of that immense multitude seems plainly an object less interesting to him, than this paltry misfortune of his own. To prevent, therefore, this paltry misfortune to himself, would a man of humanity be willing to sacrifice the lives of a hundred millions of his brethren, provided he had never seen them? Human nature startles with horror at the thought, and the world, in its greatest depravity and corruption, never produced such a villain as could be capable of entertaining it. But what makes this difference? When our passive feelings are almost always so sordid and so selfish, how comes it that our active principles should often be so generous and so noble? When we are always so much more deeply affected by whatever concerns ourselves, than by whatever concerns other men; what is it which prompts the generous, upon all occasions, and the mean upon many, to sacrifice their own interests to the greater interests of others? It is not the soft power of humanity, it is not that feeble spark of benevolence which Nature has lighted up in the human heart, that is thus capable of counteracting the strongest impulses of self-love. It is a stronger power, a more forcible motive, which exerts itself upon such occasions. It is reason, principle, conscience, the inhabitant of the breast, the man within, the great judge and arbiter of our conduct.

> When the happiness or misery of others depends in any respect upon our conduct, we dare not, as self–love might suggest to us, prefer the interest of one to that of many. The man within immediately calls to us, that we value ourselves too much and other people too little, and that, by doing so, we render ourselves the proper object of the contempt and indignation of our brethren. Neither is this sentiment confined to men of extraordinary magnanimity and virtue. It is deeply impressed upon every tolerably good soldier, who feels that he would become the scorn of his companions, if he could be supposed capable of shrinking from danger, or of hesitating, either to expose or to throw away his life, when the good of the service required it.

The other processes try it for a while, note that the conscience is unappeased, that it continues to shriek, and they note, too, that the outside world has not been even microscopically improved by the unselfish acts the conscience has demanded. They rebel at last. They pitch the tyrannous conscience down an oubliette, weld shut the manhole cover of that dark dungeon. They can hear the conscience no more. In the sweet silence, the mental processes look about for a new leader, and the leader most prompt to appear whenever the conscience is stilled, Enlightened Self-interest, does appear. Enlightened Self-interest gives them a flag, which they adore on sight. It is essentially the black and white Jolly Roger, with these words written beneath the skull and crossbones, 'The hell with you, Jack, I've got mine!"

> Actions may be laudable or blameable; but they cannot be reasonable: Laudable or blameable, therefore, are not the same with reasonable or unreasonable. The merit and demerit of actions frequently contradict, and sometimes controul our natural propensities. But reason has no such influence. Moral distinctions, therefore, are not the offspring of reason. Reason is wholly inactive, and can never be the source of so active a principle as conscience, or a sense of morals.

> His mind was destitute of that dread which has been erroneously decried as if it were nothing higher than a man's animal care for his own skin: that awe of the Divine Nemesis which was felt by religious pagans, and, though it took a more positive form under Christianity, is still felt by the mass of mankind simply as a vague fear at anything which is called wrong-doing. Such terror of the unseen is so far above mere sensual cowardice that it will annihilate that cowardice: it is the initial recognition of a moral law restraining desire, and checks the hard bold scrutiny of imperfect thought into obligations which can never be proved to have any sanctity in the absence of feeling.

> "Dear Emile, I am glad indeed to hear you speak like a man, and to behold the feelings of your heart. At your age this exaggerated unselfishness is not unpleasing. It will decrease when you have children of your own, and then you will be just what a good father and a wise man ought to be. I knew what the result would be before our travels; I knew that when you saw our institutions you would be far from reposing a confidence in them which they do not deserve. In vain do we seek freedom under the power of the laws. The laws! Where is there any law? Where is there any respect for law? Under the name of law you have everywhere seen the rule of self-interest and human passion. But the eternal laws of nature and of order exist. For the wise man they take the place of positive law; they are written in the depths of his heart by conscience and reason; let him obey these laws and be free; for there is no slave but the evil-doer, for he always does evil against his will. Liberty is not to be found in any form of government, she is in the heart of the free man, he bears her with him everywhere. The vile man bears his slavery in himself; the one would be a slave in Geneva, the other free in Paris.

> We have reached the moral order at last; we have just taken the second step towards manhood. If this were the place for it, I would try to show how the first impulses of the heart give rise to the first stirrings of conscience, and how from the feelings of love and hatred spring the first notions of good and evil. I would show that justice and kindness are no mere abstract terms, no mere moral conceptions framed by the understanding, but true affections of the heart enlightened by reason, the natural outcome of our primitive affections; that by reason alone, unaided by conscience, we cannot establish any natural law, and that all natural right is a vain dream if it does not rest upon some instinctive need of the human heart.

> It is a mistake to classify the passions as lawful and unlawful, so as to yield to the one and refuse the other. All alike are good if we are their masters; all alike are bad if we abandon ourselves to them. Nature forbids us to extend our relations beyond the limits of our strength; reason forbids us to want what we cannot get, conscience forbids us, not to be tempted, but to yield to temptation. To feel or not to feel a passion is beyond our control, but we can control ourselves. Every sentiment under our own control is lawful; those which control us are criminal. A man is not guilty if he loves his neighbour's wife, provided he keeps this unhappy passion under the control of the law of duty; he is guilty if he loves his own wife so greatly as to sacrifice everything to that love.
